These are the Terms and Conditions governing your access to and use of the website www.shetewypay.com and its related sub-domains, sites, services, and tools (the "Site"). By using this website, you agree to our terms of use as set out below. Please read the terms carefully before you start to use our site. If you do not agree to these terms of use, you must not use our service.

1. Our service

1.1 Shetewy Pay has developed this payment service (the “Service”) to make it easy for users to get their hands on virtual VISA cards (Tawwa) and to accept payment transfers easily using their digital e-wallet. Shetewy Pay operates as an electronic payment service that enables customers to make payment transactions online (the "Shetewy Pay Service"). On registration, Customers are allocated an online account (a "Customer Account"), which holds electronic money for use in online transactions.

1.2 All fees for use of Shetewy Pay Service ("Shetewy Pay Fees") are set forth in the fees schedule posted on this Site and you acknowledge and agree that Shetewy Pay Fees may be amended from time to time in accordance with the terms of this User Agreement. You should check the fees schedule posted on this Site regularly for any changes to Shetewy Pay Fees.

1.3 Beneficial Owner: You must be the beneficial owner of Shetewy Pay Account, and conduct business only on behalf of yourself.

1.4 You acknowledge and agree that: (i) Shetewy Pay is not a bank and nor is it providing banking services and/or related banking services and/or carrying out functions which are integral or closely related to banking business, nor is Shetewy Pay allowed to grant any form of credit; (ii) Customer Accounts are not insured by any government agency and that there is no voluntary or compulsory scheme in which Shetewy Pay is a member which compensates the Customer in case Shetewy Pay becomes unable to satisfy claims relating to your Customer Account or otherwise in relation to Shetewy Pay Service; and (iii) whilst Shetewy Pay acts as your agent in respect of its custody of your electronic money, Shetewy Pay does not act as a trustee or accept any fiduciary role in respect of the electronic money in your Customer Account.

2. Eligibility

2.1 In order to be eligible for using Shetewy Pay services, you must be at least 18 years old or to and if less than 18 must have parental/guardian consent.

2.2 When you sign up, you are creating a Shetewy Pay Account unique to your provided email and phone number. During the signup process to create a Shetewy Pay Account, we will ask you to provide certain information.

2.3 You must enter and maintain true, up to date, accurate and complete information as requested by us including, without limitation, your name, address, telephone number, date of birth and email address ("Information") in order to become and continue as a Customer. Shetewy Pay may (in its sole discretion) request that you provide further information or documentation to it at any time and for any reason including, without limitation, to confirm your identity, age and/or confirm ownership of your financial instruments and you agree that you will provide such information and/or documentation promptly to Shetewy Pay on request. If you do not provide such information and/or documentation promptly to Shetewy Pay on request, Shetewy Pay may, without liability, limit your use of Shetewy Pay Service or suspend or close your Customer Account. Further, you authorize Shetewy Pay to make any enquiries it considers necessary to validate and verify your identity (whether directly or through third parties) at any time for any reason at Shetewy Pay's sole discretion. Each person is only entitled to open one Customer Account. If you register more than one Customer Account, Shetewy Pay shall contact you and ask you to identify which account is to be your Customer Account. Shetewy Pay shall then, without liability, close all your other accounts and transfer any balances in those other Customer Accounts into your remaining Customer Account.

2.4 You are responsible for maintaining the confidentiality of, and restricting access to and use of, your user name, password and details of your Customer Account, and you accept responsibility for all activities that occur under or in relation to your user name, password and Customer Account. You agree to immediately notify Shetewy Pay of any unauthorized use of your user name, password or Customer Account or any other breach of security. In no event will Shetewy Pay be liable for any direct or indirect loss or damage whatsoever resulting from the disclosure of your user name, password and/or other Customer Account details. You agree to reimburse Shetewy Pay for any improper, unauthorized or illegal use of your Customer Account, whether by you or any other person. Every person who logs into the Site by entering the correct user name and password or undertakes any transaction or transfer with the correct password and Customer Account number is assumed by Shetewy Pay to be the rightful Customer Account holder and Shetewy Pay regards all related transactions and/or transfers as valid. You acknowledge and agree that Shetewy Pay will not reverse or refund any such transactions or transfers

2.5 Identity Authentication: You agree to comply with all requests made by Shetewy Pay or any of our third-party service providers in connection with your Shetewy Pay Account, to identify you, authenticate your identity, or validate the source of funding to your Shetewy Pay Account or Transactions. Shetewy Pay reserves the right to close, suspend, or limit access to your Shetewy Pay Account and/ or Shetewy Pay Services in the event that we are unable to obtain or verify such Information. You authorize Shetewy Pay directly to make any inquiries we consider necessary to validate your identity. This may include asking you for further information, requiring you to provide your date of birth or other information or form of identity that will allow Shetewy Pay to reasonably identify you, including requiring you to take steps to confirm ownership of your email, phone number, or payment instruments or verifying your Information against third party databases or through other sources. Shetewy Pay may also request to be provided with any identifying documents at any time.

3. Authorization for Handling of Funds

3.1 In order to add electronic money to your Customer Account or to otherwise purchase goods and services online using Shetewy Pay Service, you may choose from one or more options available depending on the country you are situated in. Please refer to the Top Up Section on the site for more details. You hereby authorize Shetewy Pay to obtain or receive funds on your behalf from your chosen payment source, and for Shetewy Pay to deduct all necessary fees (including Shetewy Pay Fees as per Section 6 of this User Agreement in relation to any obtaining or receiving of such funds). You also agree to upload electronic money to your Customer Account in accordance with the directions on the Site (as may be updated or amended by Shetewy Pay from time to time) and you agree that you will not use any unauthorized, invalid or illegal payment method to upload electronic money to your Customer Account.

3.2 You agree that Shetewy Pay is an independent contractor and only acts as your agent with respect to the custody of your electronic money and in facilitating the payment on third party sites, platforms and applications (a "Shetewy Pay Merchant"). Although Shetewy Pay makes reasonable efforts in reviewing Shetewy Pay Merchants, Shetewy Pay assumes no responsibility on the legitimacy or quality of the services rendered by Shetewy Pay Merchants. You acknowledge that it is your sole responsibility to identify and pay for services from Shetewy Pay Merchants that you trust.

3.3 When you make a payment from your Customer Account, Shetewy Pay will authorize the transfer of the necessary electronic money (including all necessary fees (including any Shetewy Pay Fees (as defined below)) from your Customer Account. You acknowledge and agree that if there are insufficient funds in your Customer Account to make the necessary payment, Shetewy Pay will not authorize the payment and will cancel the transaction. Shetewy Pay shall not be liable for any loss, damage or liability suffered or incurred by you that results from a transaction being cancelled in the circumstances where insufficient funds in your Customer Account prevent you from making a payment.

3.4 Methods of spending Money: By spending money, you authorize and instruct Shetewy Pay to execute the transaction. Once you have provided your authorization for the Transaction, you will not be able to cancel it, except as provided by the applicable law. You are solely responsible for confirming the accuracy of any Transactions made by you.

3.5 Shetewy Pay may delay execution of your Transaction if it has a reason to believe that your Transaction may involve fraud or misconduct, or violate the applicable law, the User Agreement, or the applicable Issuing Shetewy Pay Policies, as determined in Shetewy Pay's sole and absolute discretion.

3.6 Fraud Monitoring: Shetewy Pay may monitor your Transactions for the purpose of determining fraudulent activities and whether you are in good standing. Shetewy Pay may also decide to suspend your Shetewy Pay Account or limit your privileges. Shetewy Pay will use all available information to help combat fraud on our system.

4. Fees

4.1 You are responsible for the payment of all Shetewy Pay Fees in relation to your use of Shetewy Pay Service. The current Shetewy Pay Fees (as may be amended by Shetewy Pay from time to time in accordance with the terms of this User Agreement) are posted on the Site.

4.2 Shetewy Pay fees for adding funds to your account vary based on the method used for adding funds. Shetewy Pay may charge you fees for maintaining your account and such fees depend on the status of your account. Shetewy Pay defines the following account statuses:

4.3 Dormant Account: Any account with no transactions for a time period of 120 consecutive days, is defined as Dormant Account.

4.4 Inactive Account: Any account with no transactions for a time period of 366 consecutive days is defined as Inactive account and as the account.

4.5 Prior to registering as a Customer, and prior to carrying out any transactions using Shetewy Pay Service, you should review Shetewy Pay Fees. All Shetewy Pay Fees are due and payable immediately and shall be deducted by Shetewy Pay by automatic debit from your Customer Account. All Shetewy Pay Fees are in US Dollars unless otherwise stated on the Site. Shetewy Pay may, without liability, charge you a correction fee if incorrect payment details are provided to us by you. Please note that you are responsible for the payment of all applicable taxes, duties or other charges in relation to your use of Shetewy Pay Service.

5. Restricted Activities

5.1 You acknowledge and agree that you will not use Shetewy Pay Service: (a) to pay for any illegal material whatsoever including, without limitation, illegal downloads; (b) to pay for any goods and/or services which infringe the intellectual property or other proprietary rights of any third party; and/or (c) for, or in relation to, any illegal purpose or criminal activity of any nature.

5.2 You acknowledge and agree that Shetewy Pay will report any suspicious activity to the relevant authorities. Shetewy Pay may without liability: (a) apply such prevention and detection procedures as it deems necessary; (b) suspend or close any Customer Accounts; and/or (c) cancel or refuse to carry out any transactions, if Shetewy Pay, in its sole discretion, suspects that you are using your Customer Account or any aspect of Shetewy Pay Service for unlawful purposes or your Customer Account is otherwise being used for unlawful purposes.

5.3 You warrant that you are not violating any applicable laws or regulations by your use of the Site, your Customer Account and/or Shetewy Pay Service, and you agree to defend, indemnify and hold Shetewy Pay, its directors, employees, agents and affiliates harmless from any claim, demand (including legal fees and costs), fines, penalties or other liability made or incurred by Shetewy Pay, any Shetewy Pay Merchant, any other Shetewy Pay customer or any third party due to or arising out of your breach of this warranty.

5.4 If we have reason to believe that you have engaged in any of the restricted activities as set out above, we may take various actions to protect Shetewy Pay, Shetewy Pay Merchants, other Shetewy Pay customers, any third party or you from fees, fines, penalties and any other liability. The actions we may take include but are not limited to the following:

5.5 If we close your Customer Account, we will provide you with a notice of our actions. If we suspend your Customer Account, we will provide you with notice of our actions and the opportunity to request restoration of access, if and when appropriate. Any restoration of access shall be at Shetewy Pay's discretion.

6. Banking Protocol and Third-Party Bank Accounts

6.1 "Shetewy Pay" is not a broker or representative or has any partnership with any of the listed banks in service, including, but not limited to Albaraka Türk Katılım Bankası, Citibank Singapore, United Overseas Bank (UOB) and/or OCBC Bank. It does not control or is jointly controlled by any of the banks in service, including, but not limited to Albaraka Türk Katılım Bankası, Citibank Singapore, United Overseas Bank (UOB) and/or OCBC Bank or any "subsidiary" of any of them.

6.2 Business Day of the bank is the day when the bank carries out the activities necessary for the execution of any process in general.

6.3 The service is provided to all Shetewy Pay users who hold a verified account, or authorized partners. The service is not provided to non Shetewy Pay users, or any third-parties individuals or businesses.

6.4 Shetewy Pay can suspend this service (or any service) from your account, or block your account from creating any applications, at Shetewy Pay's discretion.

6.5 You confirm that in case this Agreement or any other agreement is concluded in English, it is understandable by you. You agree that this Agreement or any other agreement is concluded in U.S. English. or other languages that we will provide translation for.

6.6 You confirm that in case you requested opening a bank account through Shetewy Pay Banking Protocol, you agree to our terms of services and privacy policy, you agree that the selected third-party banks, and any of their partners, can verify and evaluate your identity, Shetewy Pay activity, source of the funds, risks and any other information required to properly know you. You agree to provide Shetewy Pay with all information and documents requested by it or the third-party bank to get to know you (KYC) within the deadline specified by the process. If the bank cannot properly and fully get to know you (KYC Process), your application will be rejected and is immediately terminated with notice.

6.7 In case any of your data is changed during the bank KYC process, you undertake to notify Shetewy Pay immediately and not later than within one business day by e-mail, and provide the documents related to such changes. In case of failure to fulfill the obligations provided for in this clause, You solely responsible for all consequences arising out of non-communication promptly and agrees that the actions of the banks, carried out using the last contact details known to the bank and power of attorneys, shall be deemed to have been performed properly.

6.8 For Shetewy Pay to provide the services stated, it charges standard rates and fees that are valid at the time you sign up and is deducted from your account only if a third-party bank approved your KYC process. Information on charges and rates are available on our website. If you did not submit a request to terminate the process before the KYC status is shared. The Client shall be deemed to have consented to Shetewy Pay Standard Rates and Charges.

6.9 You undertake to (1) comply with the obligations and requirements of the Agreement and the legal acts (2) to ensure that the Account and the Means of Identification provided will only be used and accessed by the Users specified in the Agreement (3) to ensure the security of the ID and debit cards provided by the third-party banks and not writing down its information or sharing it and inform the bank in case your card is stolen or lost. (4) to pay Shetewy Pay applicable charges and rates including the applicable charges and/or individual requests. (5) to ensure that your Shetewy Pay Account has sufficient funds to execute the application and cover fees for the requested services.

6.10 You agree to provide Shetewy Pay with the right to record communications that occurred using the telephone, live chat, or other communications methods. Communication logs and records are considered evidence in possible disputes.

6.11 in the event of any update or change in the data provided to your selected bank, including, but not limited to, name, surname, name of the legal entity, residence or registration address, registration data, immediately, but no later than 4 business days. Having failed to properly fulfill the obligations provided for in this clause, is solely responsible for all the consequences arising therefrom.

6.12 At your own expense, upon request of Shetewy Pay, submit all documents and information required to the nearest embassy or consulate within the deadline specified by Shetewy Pay. The Client undertakes to submit the documents in the form and language as requested by Shetewy Pay. If the Client violates the obligations stipulated in this clause, Shetewy Pay has the right to demand that the Client compensates for losses caused by the violation (including, but not limited to, administration costs, the costs for the translation, delivery, and approval of the documents).

6.13 For your safety, you must prevent any unauthorized persons from using your Shetewy Pay Account or your new bank account and/or services on behalf of you, or you'll be solely responsible for all the consequences arising therefrom.

6.14 Shetewy Pay and the bank you selected will use all means of identification provided by you or is available to confirm your identity. If you uploaded your identification documents to Shetewy Pay at the time you verified your account, Shetewy Pay will share the same documents with the bank or/and its partners if necessary or needed. You will be able to login to use the bank mobile apps and login to bank web apps only after the bank approved your documents and you receive a confirmation from Shetewy Pay.

6.15 Shetewy Pay applies Standard rates and charges only after the third-party bank you selected, initially approves your KYC documents and confirms your eligibility to process your documents through Shetewy Pay. For any reason, if the process failed or you were not provided by your bank account. Shetewy Pay will refund any charges or fees deducted from your account. Refunds will not be processed if you decided to stop the process after the bank's initial approval.

6.16 Shetewy Pay can't force any bank to accept your application or reject it. If your application was approved, your relationship becomes direct with the bank itself. Shetewy Pay can't provide any technical support to your bank account. Only bank customer care can provide that to you. Never share any credentials with Shetewy Pay or any of their representatives or anyone asking you.

6.17 You must follow the third-party banks' terms and conditions. Violating the terms and conditions of third-party banks can get your bank account to be suspended or blocked. Shetewy Pay can't help resolving that if there are objectively justified reasons related to the security of your funds, or If it is suspected that the Account, the payment instruments, and/or funds are used or may be used for illegal, fraudulent, or criminal conduct, or if you violate the terms of this Agreement or other agreements between you and the bank and/or legal acts, or If it is suspected that the Account, payment instruments and/or funds may be unlawfully used by unauthorized third parties, or If the bank has suspicions about the identity of the Client and/or origin of funds.

6.18 The blocking of access to the Account and services is revoked upon submission of a written request or remote submission of the request verified by your Shetewy Pay account. The third-party bank has the right to refuse to revoke the blocking if there are reasons to believe that the reasons for blocking have not been removed. If the access to the Account and services has been blocked at the third-party bank’s initiative, the blocking is only revoked when, according to the third-party bank’s evaluation, there are no more reasons for blocking.

6.19 The third-party bank is not liable for the user’s losses arising from the use of the Account and its blocking and revoking thereof if the third-party bank has acted in compliance with the terms and conditions stipulated in the Agreement or legal acts.

6.20 The law of the selected third-party bank's country is applies to this banking protocol Agreement.

6.21 Before contacting the court, you must, within 30 days from the date of the violation, apply for a pre-emption procedure to the third-party bank for settlement of the dispute via their support email address. You must submit your claim in writing and add to the claim detailed evidence supporting the claim. The third-party bank shall respond to your claim no later than 14 days.

7. Closure of your Shetewy Pay Account

7.1 You may request that Shetewy Pay close your Customer Account at any time by contacting Shetewy Pay Customer Support. Contact details for Shetewy Pay Customer Support are on the Site. Closure of your Customer Account will not cancel any transactions that you have already undertaken, including those which are still to be paid for from your electronic money in your Customer Account.

7.2 Shetewy Pay at its sole discretion may close a Customer Account at any time upon at least one (1) week notice to the Customer and will contact the Customer to arrange for the return of any electronic money in your Customer Account. This is without prejudice to any other rights or remedies of Shetewy Pay under this User Agreement or otherwise. Shetewy Pay may suspend your Customer Account at any time without notice if involved or suspected of involvement in fraudulent or illegal activities

7.3 If you do not log in to your Customer Account for more than six (6) months, and there are no funds in your Customer Account, Shetewy Pay may suspend your Customer Account. If your account is suspended, you should contact Shetewy Pay Customer Support to reactivate your Customer Account. Shetewy Pay will reactivate your Customer Account at its sole discretion.

7.4 Shetewy Pay may, at any time, at its sole discretion, discontinue your use of your Customer Account or Shetewy Pay Service or any part thereof. Shetewy Pay shall endeavor to provide notice of any such discontinuation of your Customer Account or Shetewy Pay Service. You agree that Shetewy Pay shall not be liable to you or any third party in relation to any inability for you to access to your Customer Account or Shetewy Pay Service or any part thereof.

7.5 Shetewy Pay will return to you any electronic money which is in your Customer Account as soon as practicable after its closure by the most suitable payment method which Shetewy Pay, in its sole discretion, shall direct to the Customer, provided that the Customer can provide Shetewy Pay with either: (a) valid bank account details where the name and address details of the bank account holder match the name and address details of the Customer as registered by the Customer on the Site; or (b) a copy of a valid form of ID acceptable in its sole discretion to Shetewy Pay (e.g. a passport or driving license). Shetewy Pay has the right not to return disputed funds or any funds, which relate to a breach of this User Agreement until such time as the dispute in relation to such funds has been resolved or, in relation to a breach of this User Agreement, a court of competent jurisdiction has determined the matter.

8. Disclaimers and Limitation of Liability

8.1 Shetewy Pay makes no representations or warranties as to the continuous, uninterrupted or secure access to Shetewy Pay Service or to your Customer Account, which may be affected by factors outside of our control, or may be subject to periodic testing, repair, upgrade or maintenance.

8.2 Use of the Site is at your own risk. The Site is provided on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty or guarantee of any kind whether express or implied, including, but not limited to, the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy

8.3 Shetewy Pay shall make reasonable efforts to ensure that all transactions are processed in a timely manner. However, Shetewy Pay makes no representations regarding the amount of time needed to complete processing of any particular transaction or transfer, nor shall Shetewy Pay be liable for any direct or indirect losses or damages arising from any such delay

8.4 Shetewy Pay Service is limited to providing the Customer with a payment facility and does not ensure the quality, safety or legality of the transaction Customer is undertaking.

8.5 The Site may include links to third party websites that are controlled or maintained by others. Accordingly, Shetewy Pay cannot accept any responsibility for the materials or offers for goods or services featured on such websites. Any link to other websites is not a warranty that such websites will be free of viruses or other such items of a destructive nature and you acknowledge and agree that Shetewy Pay is not responsible for the content or availability of any such websites

8.6 Shetewy Pay, its directors, employees, agents and affiliates will not be liable for any loss or damage (whether direct or indirect or consequential loss or damage) whatsoever (including, without limitation, loss of business, opportunity, data, goodwill or profits) arising out of or in connection with your use of the Site, your Customer Account and/or Shetewy Pay Service (or any part thereof) whether caused by negligence or otherwise, including without limitation arising out of or in connection with:

8.7 Any payments made to the wrong recipient or incorrect payments from your Customer Account due to your input of incorrect information on the Site or on a Shetewy Pay Merchant's Site;

8.8 Any fraud, deception or misrepresentations as a result of any act, omission or negligence by you in relation to your Customer Account;

8.9 Any fraud, deception or misrepresentation by the recipient of electronic money sent from your Customer Account; Any losses and/or damages resulting from a recipient's decision not to accept a transfer from your Customer Account;

8.10 Delays, losses, errors, or omissions resulting from failure of any telecommunications or any other data transmission system and the failure of any central computer system, servers or any part thereof; and The results of acts of any governmental or other authority, any act of God or other force majeure event.

9. Indemnity

9.1 You agree to indemnify and hold Shetewy Pay, its directors, employees, agents and affiliates harmless from and against any breach by you of this User Agreement, including without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs and expenses) howsoever suffered or incurred by Shetewy Pay, any other Shetewy Pay customers or any third parties (including any Shetewy Pay Merchants) due to or arising out of your breach of this User Agreement.

10. Transfer of Rights and Obligations

10.1 You hereby grant Shetewy Pay the right to, and irrevocably acknowledge and agree that Shetewy Pay may at any time, transfer all or any part of its rights, benefits, obligations or liabilities (whether express or assumed) under this User Agreement. Shetewy Pay shall endeavor to provide you with notice of any transfer by way of a posting on the Site. You may not, at any time, without the prior written consent of Shetewy Pay, transfer all or any part of your rights, benefits, obligations or liabilities (whether express or assumed) under this User Agreement without the prior written consent of Shetewy Pay.

11. Disputes with Shetewy Pay

11.1 If any dispute, claim, controversy or difference (including in relation to any tortious or statutory claim) ("Dispute") arises out of or in connection with or in relation to this User Agreement, then the parties shall first attempt amicably to settle the Dispute through good-faith negotiations over a period of thirty (30) calendar days commencing on the date that a party first sends to the other party a written notice of the Dispute. In the event that a Dispute has not been settled amicably by the relevant parties by the end of such thirty (30) day-period, the parties hereby agree that the Dispute shall be referred to and finally resolved as described in Section 19 below Except if otherwise agreed by the parties.

11.2 Shetewy Pay's failure to act with respect to a breach by you or others does not waive Shetewy Pay's right to act with respect to subsequent or similar breaches.

11.3 You are responsible for all liabilities, financial or otherwise, incurred by Shetewy Pay, a User, or a third party caused by or arising out of your breach of this User Agreement, your use of Shetewy Pay Services, and any use of your Shetewy Pay Account. You agree to reimburse Shetewy Pay, a User, or a third party for any and all such liability, to the extent not prohibited by the applicable law. The consequence of any breach of the terms of your Shetewy Pay Agreement will be covered by that agreement, separately and independently from these Terms of Service.

11.4 Reimbursement for Your Liability: To the extent permitted by law, we may collect from you any obligations that you owe us under this User Agreement. To the extent permitted by law, we may also collect from you, by any collection means available to us, any amounts we pay or incur in connection with reimbursable claims. Additionally, as applicable, you agree to cooperate with Shetewy Pay, and any third party associated with Shetewy Pay Services.

12. Governing Law

12.1 This User Agreement shall be governed by and construed in accordance with the laws of Singapore. The courts of Singapore have exclusive jurisdiction to settle any dispute arising out of or in connection with this User Agreement (including a dispute regarding the existence, validity or termination of this Agreement.
